Terms & Conditions

Euroleague Ventures SA is the exclusive holder on an international level of all the audio-visual, marketing and commercial exploitation rights of the professional basketball competitions currently named Turkish Airlines EuroLeague and 7DAYS EuroCup which pursuant to an agreement with Euroleague Ventures SA are managed and organized by Euroleague Properties SA. Euroleague Ventures SA and Euroleague Properties SA shall each, and collectively, be referred to as the “Euroleague Basketball”.

Euroleague Basketball (also referred to as 'Euroleague', 'We', 'Our') provides you its websites www.euroleague.net, www.eurocupbasketball.com, www.euroleaguebasketball.net, www.techchallenge.euroleague.net, www.adidasngt.com, id.euroleague.net ('Euroleague Websites') and the Euroleague Basketball applications, including but not limited to mobile apps and tablet apps ('Euroleague Apps') (together 'Euroleague Platforms'), including any services, content and software ('Services'), subject to the following Terms and Conditions and any documents referred to in them ('Terms').

These Terms may be amended or modified, or new conditions may be imposed at any time Any such changes or additions will be reflected by an update of this posting. You must review these Terms at (TBC)l on a regular basis to keep Yourself informed of any changes. By using the Euroleague Platforms, you agree that the posting of new or revised Terms on or within the Euroleague Platforms shall constitute adequate and constructive notice to You of any and all changes. Continued use of the Euroleague Platforms following any such changes shall constitute Your acceptance of such changes.

Acceptance of the Terms

By accessing, downloading, installing, or using the Euroleague Platforms including without limitation when you view or access videos or other content, whether or not You become a registered user ('User', 'You', 'Yourself', 'Your'), You signify Your agreement with and understanding of the following Terms and the legal information pertaining to both the Euroleague Platforms and any material on them, which You acknowledge that You have read and understood. If You do not agree to these Terms, please do not access the Euroleague Platforms.

In addition, when using particular Services, You and Euroleague shall be subject to any specific guidelines or rules related to such concerned Services that may be posted on the Euroleague Platforms from time to time. All such guidelines or rules are hereby incorporated by reference into these Terms. To the extent that there is any inconsistency between these Terms and any other guidelines or rules, those guidelines or rules shall prevail in respect of the concerned Services

Registration data

Certain areas of the Euroleague Platforms require registration ('Restricted Areas'). By registering, You represent and warrant that: (i) You are eligible for an account as set forth in these Terms; and (ii) the information You include as part of the registration process is accurate and not misleading. Accounts may be obtained and used only by: (i) individual, independent persons who are eighteen (18) years old or of legal age in their country of residence if such age exceeds eighteen (18); (ii) those individuals whose registration has been authorised either by their parents or legal guardian if they are below the legal age in their respective country of residence; or (iii) individuals with the right and authority to act on behalf of an organisation or entity for the purposes of accessing and using the Euroleague Platforms.

In respect of Your use of these Restricted Areas, You agree to: (i) provide true, accurate, current and complete information about Yourself as prompted by the registration form ('Registration Data'); and (ii) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. You can access Your Registration Data by logging into Your account.

If Euroleague has reasonable grounds to suspect that You have provided, any information that is untrue, inaccurate, not current or incomplete, or Euroleague otherwise reasonably considers that You have failed to comply with any provisions of these Terms, Euroleague has the right to immediately suspend or terminate Your account and refuse You access to any and all current or future use of the Euroleague Platforms (or any portion thereof).

You acknowledge and agree that Euroleague may rely on the Registration Data to send you important information and notices regarding your account and the Euroleague Platforms.

You acknowledge and agree that Euroleague shall have no liability associated with or arising from your failure to maintain accurate Registration Data, including, but not limited to, your failure to receive critical information about the Euroleague Platforms or your account. You further agree that Euroleague is authorized to verify such Registration Data.

For Euroleague promotions, apps and/or competitions, votes, contests and sweepstakes run on the Euroleague Platforms and/or social media websites, the following special rules apply (in addition to the all special terms set forth applicable to the promotion, app or competition, balloting, contest or sweepstake if applicable):

• Promotions, apps and/or competitions, votes, contests and sweepstakes are in no way sponsored or administrated by or associated with the social media website.
• Any information will only be provided to Euroleague and not to the social media website.
• Winners will be notified by email and not through the social media website.

Google Play Store and Apple App Store

In order to use the Euroleague Apps, You must have an account on the Google Play Store, owned and operated by Google Inc., or an Apple ID on the Apple app store, owned and operated by Apple Inc. Your use of the Google Play Store is governed by a separate and independent legal agreement between You and Google Inc. consisting of the Google Terms of Service (found at http://www.google.com/accounts/TOS), the Google Play Store Terms of Service (found at http://www.google.com/mobile/android/market-tos.html), and the Google Play Store Business and Program Policies (found at http://www.google.com/intl/en_us/mobile/android/market-policies.html) (all together 'Google Terms'). Your use of the Apple app store is governed by a separate and independent legal agreement between You and Apple Inc. consisting of the Apple Website Terms of Use (found at http://www.apple.com/legal/internet-services/terms/site.html), the iTunes store Terms of Sale and Terms and Conditions (found at http://www.apple.com/legal/internet-services/itunes/us/terms.html#service), and the Apple App store Terms of Sale and Terms and Conditions (found at http://www.apple.com/legal/internetservices/itunes/appstore/jm/terms.html#SERVICE) (all together 'Apple Terms'. Euroleague disclaims any liability in respect with these accounts and related regulations.

You may not access or use the Euroleague Apps if You do not comply with the Google Terms or Apple Terms. These Terms shall prevail in case of contradiction with the Google Terms or Apple Terms.

Login using other accounts (Facebook, Twitter, Instagram, Windows Live, Google, Yahoo!)

In case You sign in via another authentication service provider, Euroleague may receive some information from this service provider, but You remain solely responsible for Your whole relationship with such service provider, including, without limitation, any content on the website of this service provider.

In case You terminate Your membership with the service provider and/or terminate the links between the service provider and the Euroleague Platforms, Euroleague will delete all data received from the service provider concerning You if You ask Euroleague to do so. You can do so using the same way as for the ability to update or delete Your personal data as defined in the Privacy Policy.

If the service provider will disable any links to the Euroleague Platforms, Euroleague will delete all your data received through the use of the service provider's API, unless it is a basic account information or Euroleague have received explicit consent from you to retain your data.

Member account, Password and Security

If you opt to register for any portion of the Euroleague Platforms you may be required to establish an account and provide a username and password. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under Your password and account. You authorize Euroleague to process any and all account transactions initiated through the use of your username and password.

You agree to: (i) immediately notify Euroleague of any unauthorized use of Your password or account and any other breach of security; and (ii) ensure that You exit from Your account at the end of each session.

In no event will Euroleague be liable for the unauthorized use or misuse of your username and/or password. Euroleague may need to change usernames allocated to certain of our products and services and Euroleague reserves the right to do so. You will be informed of this if the Euroleague makes such a change. Euroleague collects and uses your username, password and other Registration Data in accordance with the Privacy Policy of the Euroleague Platforms

Children: parents and guardians

The Euroleague Platforms are general audience. Euroleague is concerned about the safety and privacy of all its Users, particularly those not yet of legal age in their respective country of residence. We do not knowingly collect and/or share personal information from children under the legal age on the Euroleague Platforms. However, your child cannot use some of the interactive features of the Euroleague Platforms without providing personal information. For this reason, parents / guardians who wish to allow their children access to the Euroleague Platforms should review these Terms and assist such children with the setting up of any relevant accounts and supervise the child's access to the Euroleague Platforms. By allowing Your child access to the Euroleague Platforms, he or she will be able to access all of the Euroleague Platforms, which may now or in the future include public and private communication tools as well as other features that may not be appropriate for use by unsupervised children. Accordingly, as the legal guardian, it is Your responsibility to determine whether any of the Euroleague Platforms and/or information, data, text, software, music, sound, photographs, graphics, video, messages, feeds offered through the Euroleague Platforms ('Euroleague Feeds'), application programming interface ('Euroleague API'), and any other material on the Euroleague Platforms ('Content') are appropriate for Your child. Euroleague disclaims any liability in this respect.

Euroleague Platforms Content

The Euroleague Platforms include: (i) Content provided by Euroleague ('Euroleague Content'); (ii) Content that is uploaded, posted, submitted or otherwise transmitted by Users of the Euroleague Platforms ('User Submissions'); and (iii) Content that is uploaded, posted, submitted or otherwise transmitted by third parties ('Third Party Content').

Euroleague Content

All Euroleague Content is owned by, or licensed to, Euroleague. Euroleague Content is provided to You 'AS IS' and may not be used, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any other purposes than their access and usage on the Euroleague Platforms. For that sole and exclusive purpose, Euroleague grants to You a limited, revocable, non-exclusive license to access and use the Euroleague Platforms privately for non-commercial purposes, in accordance with these Terms.

User Submissions

You retain all rights in any User Submission that You provide to the Euroleague Platforms. You shall be solely responsible for Your own User Submissions and the consequences of uploading them.

Euroleague Platforms provide in some cases unfiltered access to User Submissions. You understand and agree that Euroleague only acts as a platform for such User Submissions and that We have no liability related to such content posted on the Euroleague Platforms, whether arising under intellectual property laws, libel, privacy, obscenity, or otherwise. Euroleague cannot, nor does it undertake any obligation to control User Submissions. By their very nature, User Submissions on the Euroleague Platforms are changed frequently, may be inaccurate and in some cases, may be mislabeled or deceptively mislabeled. Euroleague does not make any representation or warranty, express or implied, as to User Submissions.

You represent and warrant that Your User Submissions: (i) shall not infringe any copyright, patent, trademark, trade secret, or other proprietary right or right of publicity or privacy; (ii) shall not violate any law or regulation; (iii) shall not be defamatory or trade libelous; (iv) shall not be obscene or contain pornography; (v) shall not include incomplete, false or inaccurate information about Yourself or any information about any other individual; and (vi) shall not contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programmes that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. You in particular represent and warrant that You have the written consent, release, and/or permission of each and every identifiable individual person in any User Submission to use their name or likeness.

You grant to Euroleague an irrevocable, worldwide, non-exclusive, royalty-free, perpetual, sub-licensable, transferable license to use, reproduce, distribute, prepare derivative works of, display and perform User Submissions in connection with the Euroleague Platforms or Euroleague’s (and its successor's) business, including, without limitation, for the purpose of promoting and redistributing part or all of the User Submissions (and derivative works thereof) in any and all media formats and through any and all media channels. You also hereby grant each User of the Euroleague Platforms a non-exclusive license to access and use Your User Submissions through the Euroleague Platforms.

You understand and agree that Euroleague has no obligation to post any User Submission from You or anyone else. In addition, Euroleague may, in its sole discretion, remove or delete any User Submission that You post or submit, as well as terminate Your access to the Euroleague Platforms without notice if, in its opinion, such User Submission infringes another's intellectual property rights or otherwise does not comply with any provision of these Terms. In particular, Euroleague reserves the right to determine the final design, layout and functionality of the Euroleague Platforms, which may involve the review, formatting and editing of User Submissions.

Third Party Content

Your business dealings with, or participation in promotions of, any advertisers and merchants found on or through the Euroleague Platforms, including payment for and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between You and such advertiser or merchant. You agree that: (i) Euroleague shall not be responsible or liable for any loss or damage of any kind incurred as the result of any such dealings or as the result of the presence of such advertisers or merchants on the Euroleague Platforms; and (ii) any orders placed by You on, and any product specifications and product availability appearing on the Euroleague Platforms (including, without limitation, any online store) are subject to confirmation by, and the terms and conditions of business of, the relevant advertiser or merchant.

Third parties may provide, and the Euroleague Platforms may contain, APIs, links or feeds from or to other websites or resources. Because Euroleague has no control over such sites and resources, You acknowledge and agree that Euroleague is not responsible for the availability of such external sites or resources, and does not endorse, and is not responsible or liable for, any content available on such sites or resources. YOU FURTHER ACKNOWLEDGE AND AGREE THAT UEFA SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS CAUSED OR ALLEGED TO HAVE BEEN CAUSED BY OR IN CONNECTION WITH THE USE OF, OR RELIANCE UPON, ANY SUCH CONTENT, GOODS, SERVICES OR ANY OTHER MATERIAL AVAILABLE ON OR THROUGH ANY SUCH APIS, LINKS OR FEEDS FROM OR TO OTHER WEBSITES OR RESOURCES.

In the event that You wish to establish a link to any Euroleague Platform, You expressly agree: (i) not to include the Euroleague Platform into the frame of another website; (ii) not to create any third party association with the Euroleague Platform; (iii) to properly attribute the Euroleague Platform referred to in Your link to Euroleague Basketball; and (iv) to ensure that the link does not state nor imply that Euroleague Basketball approves of, sponsors or endorses any other website activity, company, resource or entity, or presents Euroleague Basketball and/or its activities in a false, misleading, defamatory or derogatory manner or otherwise damages Euroleague Basketball’s reputation or takes advantage of it.

A link to the Euroleague Platforms does not permit You to use any Euroleague Basketball and/or Third Party Content, names, logos, pictures or trademarks, unless separately and previously agreed to in writing by the relevant rights-holder.

Euroleague Basketball reserves the right to require You at any time to remove any link to the Euroleague Platforms.

Cookies

From time to time the Euroleague Platforms may place a cookie on your computer. A "cookie" is a small line of code that is stored in your browser when you visit a cookie-enabled website. A cookie allows us to track and keep records on user activity. Most browsers are initially set to accept cookies. If you set your browser to reject cookies, it is possible that some parts of the Euroleague Platforms will not function. For a more detailed information we recommend you to read our Cookies Policy.

Euroleague Basketball Statistics

Euroleague may make available on the Euroleague Platforms statistics, including statistics generated and/or calculated by Euroleague using proprietary calculations and analyses, relating to or arising out of the performance of players during or in connection with the Turkish Airlines EuroLeague and the 7DAYS EuroCup games, as well as other Euroleague Basketball games, competitions or events (collectively, "Euroleague Statistics"). By using such Euroleague Statistics, you agree that: (1) any use, display or publication of the Euroleague Statistics shall include a prominent attribution to www.euroleague.net and/or www.eurocupbasketball.com in connection with such use, display or publication; (2) the Euroleague Statistics may only be used, displayed or published for legitimate news reporting or private, non-commercial purposes; (3) the Euroleague Statistics may not be used in connection with any sponsorship or commercial identification; (4) the Euroleague Statistics may not be used or referred to in connection with any gambling activity (including legal gambling activity); (5) the Euroleague Statistics may not be used in connection with any fantasy game or other commercial product or service; (6) the Euroleague Statistics may not be used in connection with any product or service that presents a live, near-live or other real-time or archived play-by-play account or depiction of any Euroleague Basketball game; and (7) the Euroleague Statistics may not be used in connection with any web site, product or service that features a database (in any medium or format) of comprehensive, regularly updated statistics from Euroleague Basketball games, competitions or events without the Euroleague’s express prior consent.

Trademarks and copyright information and agents

Euroleague Basketball and its competitions logos, the emblems of Euroleague Basketball competitions, the Euroleague Basketball event marks and product and service names are trademarks and copyright material of Euroleague Basketball (Euroleague Marks').

Nothing in the Euroleague Platforms is designed to grant any license or right to use any Euroleague and/or Third Party Content, names, logos, pictures or trademarks other than provided in the present Terms.

Any re-publication or re-distribution of Third Party Content (e.g. pictures, graphics, games, community/social tools, interactive features text, translation, interpretation, video, audio and football data content/editorial elements), including by framing or similar means, is expressly prohibited without the prior written consent of the relevant right holders. Euroleague Basketball shall not be liable for any errors or delays in Third Party Content, or for any actions taken in reliance thereon. Please consult the respective websites of the concerned right holder for additional information.

Euroleague Basketball respects the intellectual property of others. If You believe that any of Your intellectual property rights have been infringed on the Euroleague Platforms, please provide us with the following information: name, last name, address, email address, type and extent of infringement (date, time, etc.) by sending us an email at legal@euroleague.net

Euroleague Platforms modification

Euroleague reserves the right at any time to modify or discontinue, temporarily or permanently, the Euroleague Platforms, the Services (or any part thereof) with or without notice. You agree that Euroleague shall not be held liable to You or to any third party for any modification, suspension or discontinuance of the Euroleague Platforms and Services. Although Euroleague will take reasonable care in ensuring the Euroleague Platforms and the Services are up to date, any of the Euroleague Platforms and the Services may be out of date at any given time, and Euroleague is under no obligation to update it.

Privacy Policy

By using the Euroleague Platforms, Services, and Euroleague Content, You or any person You allow to access and use Your account may provide Euroleague with or Euroleague collects certain personal data, including the Registration Data and certain other information about You. By accessing or using the Euroleague Platforms, or submitting Your personal information to the Euroleague Platforms, You agree to Euroleague’s use of such data in accordance with the Euroleague Privacy Policy set out at (TBC) ('Privacy Policy').

Disclaimer of warranties and damages. Limitation of liability

If You access and use our Platforms, You do so at Your sole risk. The Euroleague Platforms, the Services, or the Euroleague Content is provided on an 'as is' and 'as available' basis. Euroleague expressly disclaims, and You waive, all warranties of any kind, whether express or implied, including, without limitation, implied warranties or merchantability, fitness for a particular purpose and non-infringement.

Euroleague makes no warranty or representation that: (i) the Euroleague Platforms, the Services, or the Euroleague Content will meet Your requirements; (ii) the Euroleague Platforms, the Services, or the Euroleague Content will be uninterrupted, timely, secure, or error-free; (iii) the results that may be obtained from the use of the Euroleague Platforms, the Services, or the Euroleague Content will be accurate or reliable; (iv) the quality of any products, services, information, or other material purchased or obtained by You through the Euroleague Platforms, the Services, or the Euroleague Content will meet Your expectations; and (v) any errors in the Euroleague Content will be corrected.

Any material downloaded or otherwise obtained through the use of the Euroleague Platforms, the Services, or the Euroleague Content, is done at Your own discretion and risk. You will be solely responsible for any damage to Your computer system or loss of data that results from the download of any such material.

Commentary and any other materials posted on or within the Euroleague Platforms, the Services, or the Euroleague Content are not intended to amount to advice on which reliance should be placed. No information, whether oral or written, obtained by You from Euroleague, or through or from the Euroleague Platforms, the Services, or the Euroleague Content, shall create any warranty or other obligation not expressly stated in the Terms and Euroleague disclaims all liability and responsibility arising from any reliance places upon such materials by any visitor to the Euroleague Platforms or by anyone who may be informed of any of its services or Euroleague Content.

You expressly acknowledge and agree that Euroleague shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Euroleague has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Euroleague Platforms, Services, or Euroleague Content; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Euroleague Platforms; (iii) unauthorized access to, or alteration of, Your transmissions of data; (iv) statements or conduct of any third party on the Euroleague Platforms, Services, or Euroleague Content; (v) results of the Euroleague Platforms, Services, or Euroleague Content, any of the Euroleague Platforms, Services, or Euroleague Content linked to it and any materials posted on it; or (vi) any other matter relating to the Euroleague Platforms, Services, or Euroleague Content.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, or related to, the use of the Euroleague Platforms, Services, or Euroleague Content, must be filed within one (1) year after such claim or cause of action first arose.

Indemnity

You agree to indemnify and hold Euroleague and its subsidiaries, affiliates, licensors, licensees, officers, agents, co-branders and other partners, and employees, harmless from any and all liabilities, losses, damages, claims, penalties, fines, costs and expenses, including without limitation reasonable legal fees, that may arise in connection with: (i) Your use of and access to the Euroleague Platforms, the Services, or Euroleague Content, including without limitation any content, or User Submission, as well as Your connection to the Euroleague Platforms, Services or Euroleague Content; (ii) Your failure to comply with any provision of the Terms; or (iii) any claim by a third party that any of Your User Submissions or any other use of the Euroleague Platforms, Services, or Euroleague Content, by You infringes any intellectual property, other proprietary or privacy right of such third party or has otherwise caused damage to a third party.

Exclusions and Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of Clauses above may not apply to You.

Nothing in these Terms shall affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of Euroleague or any other liability which cannot be excluded or limited under applicable law.

Termination

Euroleague may, in its sole discretion and without liability to You, with or without cause, in particular if You do not comply with these Terms, the Google Terms, or the Apple Terms, with or without prior notice and at any time: (i) terminate Your access (whether restricted or not) to the Euroleague Platforms in whole or in part; and (ii) deactivate or delete any of Your accounts and all related information and files in such accounts as well as Your User Submissions.

Contact and Notices

Although absolute security cannot be guaranteed on the Internet, please be assured that we have in place security measures to protect the confidentiality of your information. We will continue to maintain and improve these measures over time in line with legal and technological developments.

You can contact us at any time at digital@euroleague.net to see the personal information we have collected through the Euroleague Platforms that relates to you. To protect your privacy and security we will take reasonable steps to verify your identity before granting access.

General Provisions

These Terms (including the specific terms applicable to certain Services) constitute the entire agreement between You and Euroleague in relation to their subject matter, superseding and extinguishing any prior agreements, arrangements, undertakings of any nature, between You and Euroleague, whether oral or written in relation to such subject matter. You may be subject to additional terms and conditions that may apply when You use affiliate services, Third Party Content or third-party software.

Any failure by Euroleague to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.

If any provision of the Terms is found to be invalid, the parties nevertheless agree that the parties' intentions, as reflected in the provision, shall be given effect to the fullest extent practicable, and the other provisions of the Terms remain in full force and effect. The section titles in the Terms are for convenience only and have no legal or contractual effect.

You may not assign or transfer any of Your rights or obligations, or subcontract the performance of any of Your obligations, under these Terms. Euroleague may assign or transfer any right or obligation, or subcontract the performance of any of its obligations, under these Terms to any third party at any time without Your consent.
